January/February

 

        1.          “Right to Know

A request has been received and processed according to City ordinance.  Public records have been made available to requestor for his review in the City Manager’s Office.  

        2.          Snow Removal Procedures

PW Director, Randy Nebel and I met with the TASD Superintendent and, bus transportation people to go over procedures followed for road maintenance.  This was instituted as a result of a parent complaint received at the school, bus garage and City Hall regarding condition of a roadway here in Titusville.

        3.          Fire Negotiations

Currently we are gathering for arbitration proceedings information requested by Rich Miller of Campbell, Beatty and Durrant (the city’s labor negotiator). 

        4.          Single Application/ DCED

Dean Fernsler of DCED and I spoke re: the City’s Phase II EIP requests.  I am working on the single application with his guidance for the Citizen Survey/Community Visioning and Computer Security/ Computer Upgrades.   I also provided him a faxed copy of our letter of Intent (fire feasibility), the letter send to Oil Creek COG re: the feasibility study (water and sewer) and an article published in the Herald following the meeting of Oil Creek Area COG. 

        5.          Titusville Planning Commission

At the request of the Chair, a letter was prepared and forwarded to Titusville Planning Commission providing further clarification regarding delineation of purpose and separation of duties in regards to testimony by the Chair at a Zoning Hearing Board on January 11, 2007.  (Letters Attached).

6.     Avian Task Force

Sub-Committee meetings of the Community/ Public Relations and   Workforce Planning/ Employee/Public Health have been conducted since the last quarterly meeting.  See attached agenda and meeting notes.  On February 6, 2007 I participated along with representatives of UPT and TASD in a web cast at TASD which was sponsored by the American Red Cross entitled “Pandemic Flu Public Information Series: Are You Prepared.  All Task Force Steering Committee members were welcome.

7.    Consent Order and Agreement

A letter has been prepared by HMM and forwarded by the City to David Balog of DEP with a $500.00 processing fee (see attached).

8.    Cable Franchise Renewal

 At the request of Ike Mutlu, a cc. of the draft document has been electronically

 9.     Wellhead Protection Committee

The Committee met on Wednesday, January 17th at 3:00 PM in City Hall.        Grant applications for the WREN program are being prepared in conjunction with Mike Reynolds of the TASD for expansion of the annual water resource program conducted at the Middle School each May.

         10.        ICMA Survey

Completed and forwarded International City Management Association Survey: Leaders of the Core Better Communities survey (see attached). 

         11.        Board of Health

Prepared and mailed correspondence requested from the Board regarding Article 1103.  

         12.        Storm Water Management Ordinance

Requested review of storm water management ordinance in response to Altomyer land development project and fee request for review of documents submitted by applicant.

         13.        Industrial Pretreatment Program

The Quarterly Report was prepared by HMM and submitted by the City for the 4th Quarter of 2006 (see attached).

March/April

 

1.   Wellhead Protection Committee- met on April 25th for the quarterly meeting.  By laws for the Committee was adopted and you will find attached to your report.

 

2.      Industrial Pretreatment Program – Quarterly Report was completed and submitted (see attached).  Copy of report is available for inspection in the City Manager’s Office.

3.      Landlord Task Force Committee Meeting- meetings continue to be conducted each Tuesday with the exception of May 15th, 2007 which was cancelled.  Progress is being made. 

4.      Walking Tour- Phase II- Walk was conducted  through all the phase II locations to determine best location for placement of signs and easement agreements are being prepared for three (3) of the ten (10) locations by the City Solicitor.

5.      Grant Award DCNR /Burgess Recreation Center- meeting with DCNR regarding the planned improvements is scheduled for June 13th at 11:00 AM.

6.      Dry Dam- a proposed meeting with the DEP, Bureau of Dams and Waterways is tentatively scheduled for Monday, June 25 at 5:30 PM for members of City Council. 

7.      CGI Communications- survey form complete and submitted (see attached).

8.      Regional & Community Growth Impact Study- submitted to Brook Gabel an environmental impact questionnaire.  Also submitting was the Titusville Planning Commission and Crawford County Planning.

May/June

        1.  Wellhead Protection Committee- quarterly meeting is July 18, 2007.  Public is welcome.  The Annual Drinking Water Quality Report has been mailed out to all consumers.  (See attached news release). 

 2.  Industrial Pretreatment Program – New streamlining regulations promulgated by the U.S. Environmental Protection Agency require the City of Titusville to evaluate each of the industrial user facilities for the potential for slug discharges to the City’s sewer system.   A letter has gone out to Farley’s, Horne Textile, and Titusville Dairy as it pertains to the City of Titusville’s Industrial Pretreatment Program.  A “Slug” or “Slug Load” is defined as “any discharge of a non-routine, episodic nature, or at a flow rate or concentration that would cause a violation of the prohibited discharge standards either set forth in the City’s Pretreatment Ordinance 2012 or promulgated by federal or state agencies.”  The City has sent a letter with recommended changes to its Ordinance for approval by EPA prior to bringing to City Council for their approval also. 

  3.      Landlord Task Force Committee Meeting- on City Council’s agenda this evening is a request to further study and evaluate the water rate structure for the City as a result of our meetings.  The Committee is looking for a fair and equitable way to address consumer rates and has asked that Gannett Fleming provide an analysis of the current meter system vs. an EDU type system. 

        4.      Walking Tour- Phase II- signed easement agreements have been prepared and executed by three (3) of the ten (10) new locations.   Kim Harris has been named the new Project Director by ORA as Joyce Milberg is on a leave of absence.  A meeting will be conducted in the near future to revise our timeline for the Project.   The sidewalks in front of the Ida Tarbell Home will be included in the replacement program through the stewardship of the new owners Oil Region Alliance.  Mike Henderson (ORA) has been named the Project Manager for the restoration of the Tarbell Home.

        5.      Grant Award DCNR /Burgess Recreation Center- attended a meeting with DCNR representatives  regarding the planned improvements to the Recreation Center.  Playground has been completed and a ribbon cutting ceremony is being planned for July 12th by the Leisure Service Director.  The playground was featured in a recent Erie Neighborhood edition.

        6.      Dry Dam- a meeting with the DEP, Bureau of Dams and Waterways was conducted on July 2, 2007.  Follow-up meeting is planned for end of July.   I completed and filed 3rd quarter hazard mitigation report for PEMA regarding the status of the Project.  A meeting for the public re: the Project will be scheduled for sometime later this month.  DEP Officials will be at the meeting to discuss the Project and update everyone on the status.  An announcement of the meeting date and time will be forthcoming once the details are confirmed.

  1. CGI Communications- On Thursday, June 7, 2007 videographer Bob Misulich of Creative Productions was in town video taping all around town. A final draft of the Community Video Showcase will be brought back for final approval by City Council later this month.  Thanks to all those who have participated and provided input to the Project such as the Titusville Chamber of Commerce (Lynn Cochran), Real estate (Judy Cochran and Tim Lorenz), Titusville Hospital (Jane McNierney), Titusville School District (Karen Jez), Drake Well (Barb Zolli), OC & T (John Cramer), Caboose Motel (Chris Fiely), UPT (Wm Shields), national City (Larry Fledderman),  Senior Center (Paul Lukach), Leisure Services (Jamie Beechey), Business and Industry (Mike Allyn).

  8.      Titusville Downtown Signal Improvement Project- meeting of the Stakeholders has been set for Thursday, July 19 at 9:30 AM in City Hall Council Chambers.  SAI Consulting Engineers and Penn Dot will meet with area Stakeholders to discuss the preliminary design.  If all goes according to plan new signals could be up and running by September 2008.   

  1. EMS Tax- per the latest information from the City’s Earned Income Tax Collector (EIT), Berkheimer Associates, there were 5,097 individuals employed within the City that had EIT Tax withheld during the 2006 tax year compared to 5,044 in 2005.  That represents an increase of 53 new employment opportunities created in the City in 2006.  However, only 1,676 employed actually live in the City. That means 30% of the taxpayers that had EIT withheld by Titusville employers are residents of the City and the remaining 70% live outside the City.  The top ten employers listed include the Titusville Area School District (561), Titusville Area Hospital (356), University of Pittsburgh (288), *Charter Plastics (198), *Homerwood Hardwood Flooring (151), EIJ Restaurant, Inc. (138), *GGNSC Administrative Service (102) (Golden Living former Beverly Health), Reliant Energy Corporation Services (99), *Commonwealth of Pennsylvania (78), and City of Titusville (70).  * Increased # of employees from 2005.

 10.  Community Survey and Visioning- surveys have been completed with 300 persons receiving calls.  Eight Stakeholder meetings have been set up in the month of July and invitations to attend have been mailed.   There will probably be ten when all planning is complete.   A schedule of those which the public can attend also will be published.  The next Steering Committee meeting for the Project is set for August 14, 2007.

        11.  Pandemic Exercise- Titusville Area Hospital along with all hospitals across PA participated in a week long pandemic training from June 25-29th.  The City Departments Heads and the Avian Flu Task Force were also involved in the notification.  Key Departments such as Fire, Police and PW kept a log of the events and will be taking this information back to the Avian Flu Task Force.  The next meeting of the Steering Committee for the Task Force is July 11, 2007 at 5:00 PM.

        12.  Pension Consulting Services- at a special meeting of the police and fire pension committees the firm of Morrison Fiduciary Advisors, Inc. were engaged to provide a review of the Investment Policy Statements, investment asses allocation, historical investment performance, securities trading practices, vendor fee schedules, safe keeping of fund assets, payment of retiree benefits, general administrative matters, actuarial evaluations and any other matters deemed to be important to prudent management of each Plan.  This is one of the priority projects identified by the City Council to be completed this year in light of the growing financial condition of the City and the under fundedness of the police and fire plans.

        13.  Close out of CO & A w/ DEP-  the City’s PW Director received a letter dated June 19, 2007 from Christine S. Nagy following an inspection at the WWTP.  A meeting between DEP and the City’s new Engineer’s (Gannett Fleming) will be scheduled after July 13th, 2007 to discuss the open ended items that need to be completed before release of the City’s new NPDES permit (see attached).

  1. Wellhead Protection Committee- quarterly meeting was held July 25, 2007.  The committee approved letters to go out to pharmacy, nursing home and hospital facilities (see attached).  The Committee also discussed the new development planned for the wellhead capture zone (Aaron’s).   The preparation of parking area should be reviewed by the Committee as all other developments in the area have had this same level of review.  DPW Director R. Nebel will send info packet with City ordinance to them and invite them to the October quarterly meeting to discuss their development with the Committee.  Storm water management according to Nebel should be through the existing infrastructure already in place put there by Penn Dot during the Wal-Mart construction.

 

  1.   1. Titusville Flood Control Project- a special meeting for the public was held on July 30th, 2007 to discuss Flood Control project.  It has be determined that the dry dam concept for the City of Titusville will not work due to the existence of glacial till, a condition of the soil and surrounding area that will not permit the construction of the dry dam originally recommended.  DEP, Bureau of Dams and Waterways is now recommending that the City pursue a box culvert plan.  That information is before you this evening under your regular agenda. The City Administration (Fire, PW and Manager) recommend that we pursue this alternative tonight as it presents a plan to provide relief to the City residents and any hesitation will result in further delays.  Currently approximately 100 properties most affected by the flooding are faced with threats to their health, safety and security each time there is a heavy rain event. Residual impacts such as the cost for flood insurance, difficulty with selling those properties (devaluation) and then the poor structural integrity of the buildings following years of abuse due to flooding will eventually take its toll on the housing stock along the waterway.  A flood control project will not only eliminate the threat but it will reestablish the esthetic value of the area and bring value back to the properties located in the floodway.

 

  1. Walking Tour- Phase II-  a meeting to readjust the time schedule for implementation of the Phase II Project  was held August 7, 2007 and will be delayed from the original completion date.  The new schedule is attached.

 

  1. Titusville Downtown Signal Improvement Project- meeting of the Stakeholders was held on Thursday, July 19 at 9:30 AM in City Hall Council Chambers.  SAI Consulting Engineers and Penn Dot were there to discuss the preliminary design.  If all goes according to plan new signals could be bid out for completion in 2009. Estimated cost for standard galvanized poles is $1M,  Penn Dot painted galvanized $1M + $75,000 and the decorative poles selected by TRI $1M + $400,000.  There were on going maintenance concern expressed by SAI Consultants re: painted, fluted decorative poles if the City should select such as the cost to maintain will fall to the City.  It was suggested that we check with our neighbors regarding their experience with the various types of traffic signal poles they currently maintain.  Final design contract will need to be awarded by Penn Dot in late 2008 or early 2009 with construction in 2009.  Action requested this evening from City Council includes confirmation of the dates in 2009 that need to avoid (after August 2009) due to 150 Celebration and before final design selection of  traffic pole type (standard galvanized, painted galvanized and/or decorative).

 

6.       Community Survey and Visioning- Eight Stakeholder meetings were set up in the month of July and invitations to attend were mailed.   A State of the City power point presentation and other hand-outs were prepared by the City Manager and Finance Director for presentation at each meeting.  Public was invited to attend six of the eight meetings.  Meetings were well attended and the Herald covered at least two of the public meetings in the news paper.  The next Steering Committee meeting for the Project is set for August 14, 2007 (see attached agenda).   A final report is expected by end of September or very beginning of October.

 

7.       Pandemic Exercise- The meeting of the Steering Committee for the Task Force was conducted on  July 11, 2007 at 5:00 PM.  Since the meeting displays have been set up at the Safety Fair at Robert’s Grove and one is planned for Oil Festival.  A full time display has been placed in Carpenter’s Corner front window.  A front page article was run by the Titusville Herald re: Emergency Preparedness.

 

8.      Pension Consulting Services- This is one of the priority projects identified by the City Council to be completed this year in light of the growing financial condition of the City and the under-fundedness of the police and fire plans.  Information gathering is taking place with a report expected by mid-September.

 

9.      Close out of CO & A w/ DEP-  A letter to the City from Christine Nagy was received on July 1, 2007 outlining outstanding issues that DEP still has with the City’s project.  A meeting with DEP, the City and Gannett Fleming (GF) set up for later this month.  Specifications for the installation of the back flow preventor is being designed by GF. 

 

10.  Performance Grant/ City Recycling-  a letter has gone out from the City to area    businesses to gather information for DEP performance grant application.  Last year, collection of glass bottles significantly increased due to the addition of a glass recycling dumpster at the public works garage.  Many clubs, specifically the VFW, PNA, American Legion and others, have deposited their glass bottles in the dumpster.  We wish to thank them for their efforts to recycle.  Also available at the public works garage is a cardboard recycling bin.  If you have any questions or comments, please feel free to contact the Finance director at (814) 827-5300, ext. 310 or 309.

 

11.   Cursory Review of Water Rate Study- Gannett Fleming received authorization at the July 07 meeting of City Council to review the Water Rate Study completed in November of 2006 performed by Malcolm Pirnie in order to make a recommendation for a rate basis i.e. meter size vs. edu  system.  A report to the City is nearly complete and will be forwarded later this week.    This is the result of a recommendation from the Landlord Task Force that was appointed in May 2007 to study and recommend a fair system for water rate and cost distribution.

 

12.  EADS Request- the City Engineers (Gannett Fleming, GF) received a request from the EADS Engineering Group which represents Cherrytree Twp., Venango County.  They are in the process of developing an Act 537 Sewage Facilities Plan for a defined area of Cherrytree. As a part of the Plan they are examining the option of collecting sanitary sewage from the area north of the City and conveying to the City of Titusville through the City’s collection and treatment system.  It includes approximately 140 homes with the potential growth in the future of 100 more customers.  I have requested a cost estimate from GF in order to prepare the information they have requested and will bring to City Council for their approval next month.

    1.        Wellhead Protection Committee- in response to a notice of a Conditional Use Application for Salvage Direct in OC Twp. To allow for the operation of a salvage yard in the Wellhead Protection Area with a two day notice, the following memo was prepared and sent be the WPC to the OC Twp. Wellhead Protection representative:

The following are questions that members of the WPC request that you ask this evening at the meeting in regards to the proposed operations:

 

1.             What condition will these units be in upon arrival?

 

            2.             What is the expected length of time they will be stored there?

 

3.             Are there any restrictions on the type(s) and/or the previous use of these vehicles and equipment?

 

4.             Is there any government agency responsible for monitoring/ identifying hazardous chemicals that may be residual on these components/ vehicles?

 

5.             Does the company have an emergency response plan in the event of possible spills to the water table/ capture zone;

 

6.             Are there restrictions in place for the composition of items brought to the site, and will there be restrictions placed on expansion of the number or types of items?

 

7.             What guarantees/ bonds / insurances will be in place by the company to guarantee that there is nothing leaking from the vehicles;

 

8.             How extensive will processing be on site or will they be processed elsewhere.

 

These are items that need to be answered in detail and the PW Director, City Engineer and Water Operator would like time to review the answers before conditional use is granted if possible. 

 

This is our water supply and there is extreme potential for interruption either short or long term. 

 

  1. Industrial Pretreatment Program – The City’s new pretreatment ordinance with the Streamlining Regulations promulgated by the U.S. Environmental Protection Agency requiring the City of Titusville to evaluate each of the industrial user facilities for the potential for slug discharges to the City’s sewer system has been forwarded to EPA along with copies of the revised Enforcement Response Plan and revised permit text.   New streamlining regulations take effect for Farley’s, Horn Textile, and Titusville Dairy as it pertains to the City of Titusville’s Industrial Pretreatment Program.  A “Slug” or “Slug Load” is defined as “any discharge of a non-routine, episodic nature, or at a flow rate or concentration that would cause a violation of the prohibited discharge standards either set forth in the City’s Pretreatment Ordinance 2012 or promulgated by federal or state agencies.” 

 

  1. Worker’s Compensation/ Liability Insurance- the City met with Representatives of Penn Prime and Titusville Insurance to review both the WC and Liability loss runs for the past seven years.  The City’s e-mod is dropping 25 points.  It is currently at a 1.326 and is going to a 1.071.  This should result in a savings if rates do not go up or remain flat if rates remain the same for 2008.  The City Department Heads reviewed the current injury reporting system in place since 2004 and other changes made such as pre-employment physicals for all new employees.

 

4.      Walking Tour- Phase II- a meeting to review sign text and graphics was conducted on September 11 with the sub-committee and Kim Harris Project Director.  A new time schedule for implementation of the Phase II Project will be developed and forwarded to the Committee from Kim Harris due to delays.  However, we will remain on task for a Spring 2008 completion.

Titusville Downtown Signal Improvement Project- letter has been forwarded to Penn Dot advising them of the City’s wishes to avoid construction in August 2009 due to 150 Celebration.  Penn Dot has completed its speed study of the Rt. 27 corridor east of the City of Titusville.  The study has concluded that the existing speed limits are the lowest that can be warranted per the Federal Manual on Uniform Traffic Control Devices (MUTCD) for that corridor.  They recommend that enforcement is needed to reduce the actual travel speed of vehicles through that area and prior to commencement of the enforcement efforts recommend that posting of the 25 mph speed limit on PA. Route 27 be corrected.  These corrections have been ordered through the City’s PW Department.    TRA’s consultant has not completed the warrant study for the Caldwell Street light yet.  Repairs to the traffic signal to improve safety however were made on Sept. 17th by the City’s electrician.  He is still awaiting Penelec approval for electric to light.

 

6.      Community Survey and Visioning- A meeting of the Steering Committee was held on August 14, 2007 and a meeting of the sub-committees for the Project on September 18th.  Five sub-committees have been identified to continue the work identified from the process.  A final report is expected by end of September or very beginning of October. 

7.      Pandemic Exercise- work of the Steering Committee for the Task Force continues.  A letter has been sent through the TASD for all school age children (see attached).  A full time display has been placed in Carpenter’s Corner front window and a second may be placed at Benson Library.  The next meeting is set for November. 

8.      Close out of CO & A w/ DEP-  A letter to the City from Christina Nagy was received on July 1, 2007 outlining outstanding issues that DEP still has with the City’s project.  A meeting with DEP, the City and Gannett Fleming (GF) was conducted on September 13, 2007.  A Plan will be prepared by GF to address outstanding concerns and submitted to DEP for their approval.    

9.      Cursory Review of Water Rate Study- Gannett Fleming has submitted a progress report to the City for the work authorization at the July 07 meeting of City Council for review of the Water Rate Study completed in November of 2006 performed by Malcolm Pirnie.   A review by Staff and GF has not yet been conducted.     

  1. Comprehensive Transportation Study- a letter has been sent by the City Manager on  September 6, 2007 to Howard Brush Director of the Governor’s NW Regional Office requesting assistance with possible matching funds to complete the study.  The Comprehensive Transportation Study will provide information that can assist ultimately with economic development of the area and the potential development of a (truck to rail) transload facility at the Titusville Opportunity Park. 

 

11. Cable Franchise Renewal- the City has turned over negotiations of the new franchise agreement to Cohen Law Group.  Cohen Law Group is provided as a member service through the Pennsylvania League of Cities and Municipalities (PLCM) and recently completed the negotiations for the City of Meadville.  The Cohen Telecommunications Law Group recognizes that rapid advances in telecommunications are creating both challenges and opportunities for municipal governments. The Group focuses exclusively on these matters, providing specialized counsel on all issues governed by federal law and new technologies. Specifically, the firm works with municipalities regarding cable franchise agreements, renewal negotiations and compliance review, cable rate regulation, and the preparation of cellular tower and rights-of-way ordinances.  The Cohen Telecommunications Group has represented nearly one hundred municipal clients in negotiations with cable companies and telecommunications providers.
